Sudden View is a commercial software product. To have a successful product, and produce more software, I need to be paid for each copy of my program that is seriously used. On the other hand, how do you know that you want to pay for a program until you've tried it? And what about the hassle of copy protection? How are copyrights different from copy protection? To address these and other questions, I have used the personal approach: this is between you and me. I look to each personal relationship to provide you a service, and enforce my rights. I make available a demo version of Sudden View that can be freely copied and passed around; but it contains periodic commercials and some limits on features. If you want a copy of the program with no commercials and all the bells and whistles, I only ask for a personal relationship, and $69.95. Your name, address and password is coded into your own personalized version of Sudden View. I will then rely upon my relationship with you to not violate my copyrights and not pass this personalized version of Sudden View on to your friends and relatives; give them the demo copy if they ask. If someone steals your copy, the password will protect you from further liability in the matter. If you allow anyone else to use this personalized copy and provide them with the password, I will look to you for damages from the copyright violation. This may seem a little different, but it's just old fashion integrity, backed up by enforcement. This and other aspects of Sudden View's policy is defined below in detail. Since we have a personal relationship, please call with any questions. A Personal Relationship Some companies treat software like hardware. They try to build in physical copy protection or actual hardware dongles. They end up punishing the honest customer by making the program inconvenient to use; and backup becomes a nightmare. The honest customers suffers. To overcome these problems, some other companies treat software like a book. When you're done reading it, you can give or sell it to some one else to read; but it may not be copied except for backup. The problem is, the policy can not be enforced, and is therefore a dismal failure. Some estimates put copyright violation at or about four illegal copies for each legal copy. Since software companies are under normal competitive market pressures, prices fall only to the point the company can stay in business and make a profit, or they fail. Too many fail. Because of illegal copying and these market forces, it turns out that the honest customer ends up paying five times too much for each program he buys. He's being ripped off by the guy who illegally copies software. There's no such thing as a free lunch. Somebody pays. The honest customer suffers. Still other developers have virtually thrown in the towel, and just beg for donations. It's called shareware. About one in one hundred contribute. The developer cannot afford to properly update, document or support his product. The developer probably goes broke. The honest customer suffers. I do not treat software like hardware, a book or charity. I treat it more like a relationship between a professional and a client. Legally, a software copyright is like the copyright for a book, and I rely upon this protection; but I also rely on my relationship with you to enforce these rights. This relationship should be on a personal basis, with mutual respect in all dealings. Only honest customers need apply. I provide for your need to evaluate my software by allowing unlimited copying of a demo version. I ask to know each of my customers, and I provide a personalized version of the real program for each of them. The user is encouraged to make backup copies of the personalized version, and is only inconvenienced by a password when the program is started. This is as much for the user's protection against lawsuit, as it is for the protection of my copyrights. I provide the program, answer questions and generally support it. I expect you to pay me if you order a personalized version of the software, and then protect my copyrights as you use it. I hope you find this policy reasonable. My goal is to treat the honest customer fairly. I expect no less in return. Buying Sudden View This is the Beta release of Sudden View for the Atari ST. The hard copy documentation is not yet complete. This release comes in two versions, demo and personalized. The demo version does most of what the personalized version does, but also has periodic commercials. It may be copied and given to your friends and relatives, or anyone else you run into. If the above didn't solve your problem, write down a description of what's happening and then try it again. 3. If you still don't have your solution, call Sudden Incorporated's support line at 702-827-2996. This service is available only to registered owners of the Personalized version of Sudden View; but we can take care of that when you call. Copying and Copyrights Sudden View files are not copy-protected, and can therefore be copied without resorting to special copying boards or programs; however!, all Sudden View files are COPYRIGHTED with all rights reserved. This means the you CAN copy all Sudden View files, but in certain case, you MAY not. You may make copies of the demo version of Sudden View and its documentation, provided that all files are included in each copy, and no files have been altered in any way. Altering Sudden View files is a violation of our copyrights (creating a derived work) and also may cause unpredictable operation. Complete, unaltered demonstration copies of Sudden View may be distributed for free, transmitted electronically, or copied to disks that are sold for profit. You may keep the profit in this case. The personalized version of Sudden View may also be copied, but only for the registered owner's personal use as backup. It may not be copied for other uses, distributed in any fashion or transmitted electronically. Unauthorized distribution, transmission or copying of the Personalized version of the Sudden View program file is a violation of Sudden's Incorporated copyrights and will be treated as such. Rewards will be available for information leading to convictions in such cases. If you are guilty of such a violation, you may be criminally liable for up to $50,000 and five years in jail, as well as any civil action. Civil liability could be as great as three times the value of any illegally distributed copies. If a single copy that you give to someone else ends up on an electronic bulletin board, these damages as well as the chance of being caught could be substantial. As you can see, these copyrights are worth enforcing, and they will be enforced. Rewards If you are aware of any copyright violation of any of Sudden Incorporated's products, you may be eligible for up to $10.00 per copy of any recovered damages. You will need to provide information and possibly an affidavit relating to the infringement. If you have received an illegal copy of Sudden View, but have not passed it on to anyone else, you may be eligible for a free registered personalized version for your own use by simply providing information about the illegal copy's source. If you do not report such a case, you may be as liable as the original owner for any subsequent copyright violation. See Copying and Copyrights above. If you are aware of any altered personalized version of Sudden View with password on any electronic bulletin board system, you may be eligible for up to $1,000 reward if you are the first to report the copyright infringement in which damages are recovered. Limited Warranty Sudden Incorporated ("Sudden"), warrants the physical diskette and any physical documentation presented with the program to be free of defects in materials and workmanship for a period of ninety days from the purchase date. If Sudden receives notification within the warranty period of such defects, Sudden will replace the defective materials. The entire and exclusive liability and remedy for breach of this Limited Warranty shall be limited to replacement of defective materials and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of profit, data, or use of the software, or special, incidental, or consequential damages or other similar claims, even if Sudden has been specifically advised of the possibility of such damages. In no event will Sudden's liability for any damages to you or any other person ever exceed the price paid for the license to use the software, regardless of any form of the claim. SUDDEN INCORPORATED SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Specifically, Sudden makes no representation or warranty that the software is fit for any particular purpose and any implied warranty of merchantability is limited to the ninety-day duration of the Limit Warranty covering the physical diskette and physical documentation only (and not the software) and is otherwise expressly and specifically disclaimed. This limited warranty gives you specific legal rights: you may have others which may vary from state to state. Some states do not allow the exclusion of incidental or consequential damages, or the limitation on how long an implied warranty lasts, so some of the above may not apply to you. Sudden has no money back guarantee, and there are no refunds under normal conditions. This applies to all software products. Sudden's software products should never be altered in any way. This includes changing of the source code or omitting of documentation files when copying the demo version. All warranties are specifically disclaimed if the product has been altered in any way.
